Welcome to PawGuide Thailand ("we," "us," or "our"). By accessing or using our website, mobile application, and related services (collectively, the "Platform"), you ("User," "you," or "your") agree to comply with and be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use usage of the Platform.
PawGuide Thailand provides a platform for pet owners to discover pet-friendly venues, services, and events in Thailand. We act as an intermediary connecting users with venues and do not own or operate any of the venues listed on our Platform unless explicitly stated otherwise.
To access certain features of the Platform (such as saving favorites, checking in, or writing reviews), you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.
You must be at least 18 years old to create an account. By using the Platform, you represent and warrant that you are at least 18 years of age.
You retain ownership of any Content you submit, post, or display on the Platform ("User Content"), including text, reviews, photos, videos, and other materials. However, by submitting User Content, you grant PawGuide Thailand a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content in any media formats and through any media channels, including but not limited to the Platform, marketing materials, social media, and third-party partnerships.
By submitting User Content, you represent and warrant that: (a) you own all rights to the content or have obtained all necessary permissions, licenses, and consents from the copyright holder(s); (b) you have obtained consent from any identifiable individuals appearing in photos or videos for their image to be used on the Platform; (c) the content does not infringe any third-party intellectual property rights, privacy rights, publicity rights, or other proprietary rights; (d) the content is accurate, not misleading, and complies with all applicable laws; and (e) you have the legal right and authority to grant the license described in Section 4.1.
Reviews and check-ins must be based on your genuine experience at the venue. You agree not to post reviews that are: (a) false, misleading, or fabricated; (b) defamatory, offensive, or contain hate speech; (c) submitted for any improper purpose, including paid reviews or reviews submitted in exchange for compensation; (d) posted by venue employees, owners, or their representatives without disclosure; or (e) posted by competitors or individuals with conflicts of interest. We reserve the right to remove any review that violates our content policies.
You agree not to post Content that: (a) is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable; (b) infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party; (c) contains software viruses or any other malicious code; (d) violates the privacy or publicity rights of others; (e) promotes illegal activities or discrimination; (f) contains personally identifiable information of minors; or (g) impersonates any person or entity.
PawGuide Thailand respects intellectual property rights and complies with the Copyright Act B.E. 2537 (1994) as amended by the Copyright Act (No. 5) B.E. 2565 (2022) of the Kingdom of Thailand. We act as an intermediary service provider and are not liable for copyright infringement by users, provided we comply with the notice-and-takedown procedure outlined below.
Notice of Copyright Infringement: If you believe that your copyrighted work has been uploaded to the Platform without authorization, you may submit a written notice to us at pawguidethailand@gmail.com containing the following information:
Takedown Process: Upon receipt of a valid notice that complies with the above requirements and the Thailand Copyright Act, we will promptly: (a) remove or disable access to the allegedly infringing material; (b) notify the user who posted the material of the removal; and (c) take reasonable steps to prevent repeat infringement, including terminating accounts of repeat infringers. We will process valid takedown notices within seven (7) business days of receipt.
Counter-Notice: If you believe that material you posted was removed in error or is not infringing, you may submit a counter-notice to pawguidethailand@gmail.com containing: (a) identification of the material and its location before removal; (b) a statement under penalty of perjury that the material was removed by mistake or misidentification; (c) your contact information; and (d) your consent to the jurisdiction of Thai courts. We may restore the material within 10-14 business days of receiving a valid counter-notice, unless the copyright owner files a legal action.
Platform Liability Exemption: In accordance with Sections 43/1 to 43/8 of the Copyright Act B.E. 2537 (1994), as amended by the Copyright Act (No. 5) B.E. 2565 (2022), PawGuide Thailand, as an intermediary service provider (Hosting Service Provider), shall not be liable for copyright infringement by users provided that we: (a) do not have actual knowledge that the material or activity is infringing; (b) are not aware of facts or circumstances from which infringing activity is apparent; (c) do not receive financial benefit directly attributable to the infringing activity while having the right and ability to control such activity; and (d) upon receiving proper notice of infringement ("Notice and Takedown"), act expeditiously to remove or disable access to the infringing material. Users who upload content bear sole responsibility for ensuring they have the legal right to do so.
You agree to indemnify and hold harmless PawGuide Thailand from any claims, damages, losses, liabilities, and expenses (including reasonable attorney’s fees) arising out of or related to: (a) your User Content; (b) your breach of any representation or warranty in these Terms; (c) your violation of any intellectual property or other rights of any third party; or (d) your violation of applicable laws. This indemnification obligation will survive termination of these Terms and your use of the Platform.
While we strive to provide accurate information, Venue details (including pet policies, opening hours, and prices) are subject to change. We do not guarantee the accuracy of Venue information and recommend verifying directly with the Venue before visiting.
The Platform may offer a check-in feature that allows you to earn points or rewards. We reserve the right to verify check-ins and disqualify any fraudulent or suspicious activity. Points and rewards have no cash value and may be subject to expiration or change at our discretion.
Venue Owners may claim their Venue listing on the Platform. We reserve the right to verify the identity and authority of any person claiming a Venue.
Venue Owners may purchase subscriptions to access premium features. Subscription fees are non-refundable unless otherwise stated. We reserve the right to modify subscription plans and fees upon notice.
Verified Venue Owners are responsible for maintaining accurate and up-to-date information about their venue, including but not limited to pet policies, operating hours, pricing, and contact information. To update venue information, verified Venue Owners must contact PawGuide Thailand at pawguidethailand@gmail.com. Failure to maintain accurate information may result in removal of the verified badge without refund of any previous subscription charges or fees paid to PawGuide Thailand.
Venue Owners may request removal of their venue listing or specific User Content associated with their venue by contacting us at pawguidethailand@gmail.com with proof of ownership or authorization. We will process verified removal requests within thirty (30) business days. Please note:
Venue Owners with claimed listings may respond to user reviews. Responses must be professional, factual, and not contain personal attacks, threats, or inappropriate language. We reserve the right to remove venue responses that violate our content policies.
The Platform, including its design, code, graphics, and features, is owned by PawGuide Thailand and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Platform without our prior written consent.
"PawGuide Thailand" and our logo are trademarks of PawGuide Thailand. You may not use our trademarks without our permission.
The Platform may contain links to third-party websites or content. We do not control, endorse, or assume responsibility for any third-party content. Your use of third-party websites is subject to their respective terms and conditions.
You agree not to: (a) use the Platform for any unlawful purpose or in violation of any applicable law or regulation; (b) impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity; (c) interfere with or disrupt the Platform or servers or networks connected to the Platform; (d) attempt to gain unauthorized access to any portion of the Platform or any other systems or networks connected to the Platform; (e) use any robot, spider, or other automatic device to access the Platform for any purpose without our express written permission; (f) submit false information, fake reviews, or fraudulent check-ins; (g) harass, abuse, or threaten other users or venue staff; (h) use the Platform to send spam or unsolicited communications; or (i) engage in any conduct that restricts or inhibits any other user from using or enjoying the Platform.
PawGuide Thailand reserves the right, but is not obligated, to monitor, review, edit, or remove any User Content at any time and for any reason, including if we determine that the content violates these Terms, is objectionable, or may create liability for us or harm our users. We may also remove content in response to complaints from venue owners or other users, subject to our investigation and determination.
Users and venue owners may report content that violates our policies by contacting us at pawguidethailand@gmail.com. Reports should include: (a) specific content URL or description; (b) reason for reporting; and (c) any supporting evidence. We will review reports and take appropriate action, which may include removing the content, warning the user, or suspending/terminating the user’s account.
We are not responsible for User Content posted on the Platform. The views expressed in reviews and other User Content are those of the individual users and do not represent the views of PawGuide Thailand. We do not endorse, support, or guarantee the accuracy of any User Content.
We reserve the right to suspend or terminate your account and access to the Platform at any time, with or without notice, for any reason, including but not limited to: (a) violation of these Terms; (b) fraudulent, abusive, or illegal activity; (c) prolonged inactivity; (d) requests by law enforcement or government agencies; (e) unexpected technical issues; or (f) engaging in conduct that we determine, in our sole discretion, to be harmful to the Platform, other users, venue owners, or PawGuide Thailand.
You may terminate your account at any time by contacting us at pawguidethailand@gmail.com or using account deletion features within the Platform. Upon account termination, your right to access and use the Platform will immediately cease.
Upon termination of your account: (a) you will lose access to your account, favorites, check-in history, and any accumulated points or rewards; (b) your User Content may remain on the Platform in anonymized form, as we retain a license to use such content per Section 4.1; (c) we may retain certain personal data as required by law or for legitimate business purposes (fraud prevention, dispute resolution, compliance) in accordance with our Privacy Policy; and (d) any outstanding payment obligations will remain due. Sections that by their nature should survive termination shall survive, including Sections 4.1, 7, 10, 11, 12, and 13.
Following account deletion, we will delete your personal information within ninety (90) days, except for: (a) User Content you posted (reviews, photos), which may be retained in anonymized form or with your name replaced with "Former User"; (b) data we are required to retain by law; (c) data necessary for ongoing investigations, disputes, or legal proceedings; and (d) aggregated, de-identified analytics data. Venue owners who have received your check-in data may retain it according to their own data retention policies.
Your use of the Platform is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.
When you check in at a venue, certain information (including your name and pet information) may be shared with the venue owner if they have claimed their venue on the Platform. The extent of information shared depends on the venue’s subscription tier. By checking in, you consent to this sharing.
The Platform may request access to your device’s location services to provide location-based features. You may control location access through your device settings. Some features may be limited if location access is denied.
By creating an account, you may receive service-related communications from PawGuide Thailand. Venues may also send marketing communications to customers who have checked in, subject to your communication preferences. You may opt out of marketing communications at any time.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PAWGUIDE THAILAND DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
PAWGUIDE THAILAND DOES NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY VENUE INFORMATION ON THE PLATFORM. WE ARE NOT RESPONSIBLE FOR: (A) CHANGES TO VENUE PET POLICIES; (B) DENIED ENTRY TO VENUES; (C) INJURIES TO PETS OR PERSONS AT ANY VENUE; (D) DAMAGES TO PROPERTY; (E) DISPUTES BETWEEN USERS AND VENUES; OR (F) ANY OTHER ACTIONS OR OMISSIONS BY VENUES OR THEIR STAFF.
You are solely responsible for the safety, behavior, and supervision of your pets at all times. PawGuide Thailand is not responsible for any injuries, illness, or incidents involving your pets at any venue, regardless of the venue’s verification status or displayed pet policies.
The Platform may integrate with third-party services (such as maps, payment processors, and communication services). PawGuide Thailand is not responsible for the availability, accuracy, or reliability of such third-party services.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PAWGUIDE THAILAND AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR USE OR INABILITY TO USE THE PLATFORM; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM; (C) ANY CONTENT OBTAINED FROM THE PLATFORM; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
IN NO EVENT SHALL PAWGUIDE THAILAND’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM EXCEED THE AMOUNT YOU PAID TO PAWGUIDE THAILAND, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE THOUSAND THAI BAHT (THB 1,000), WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless PawGuide Thailand and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney’s fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property rights or privacy rights; (d) your user content; or (e) any claim that your user content caused damage to a third party.
These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to its conflict of law provisions.
Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or invalidity thereof shall first be submitted to good faith negotiation between the parties for a period of thirty (30) days. If the dispute cannot be resolved through negotiation, it shall be finally settled by arbitration administered by the Thailand Arbitration Center (THAC) in accordance with its rules. The place of arbitration shall be Bangkok, Thailand. The language of the arbitration shall be Thai or English, as agreed by the parties.
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this class action waiver is found to be unenforceable, then the entirety of this dispute resolution section shall be null and void.
PawGuide Thailand reserves the right to modify these Terms at any time. We will provide notice of material changes by: (a) posting the updated Terms on the Platform with a new "Effective Date"; (b) sending an email notification to your registered email address; or (c) displaying a prominent notice on the Platform. The updated Terms will be effective immediately upon posting for new users, and thirty (30) days after posting for existing users.
Your continued use of the Platform after the effective date of modified Terms constitutes your acceptance of such changes. If you do not agree to the modified Terms, you must stop using the Platform and may terminate your account as described in Section 8B.2.
Each version of these Terms will be identified by its effective date and version number. Previous versions may be available upon request by contacting us at pawguidethailand@gmail.com.
These Terms, together with our Privacy Policy and any other legal notices published by us on the Platform, constitute the entire agreement between you and PawGuide Thailand concerning the Platform and supersede all prior or contemporaneous understandings and agreements.
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and PawGuide Thailand’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may freely assign these Terms without restriction.
PawGuide Thailand shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, government action, pandemic, or failure of third-party services.
These Terms may be provided in both English and Thai. In the event of any conflict or inconsistency between the English and Thai versions, the English version shall prevail.
Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and PawGuide Thailand. You have no authority to bind PawGuide Thailand or make commitments on our behalf.
By using the Platform, you consent to receive electronic communications from PawGuide Thailand. These communications may include notices about your account, transactional information, and service announcements. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
